It is 100% legal for anyone to setup and own a Montana LLC, regardless of where they live. Your home state will have regulations on its books—under Use Tax laws—which are administered by your home state’s Department of Revenue or Equalization, and you do need to follow any limits on vehicle usage they may require. We recommend that you look those up, and read them with the understanding that a Montana LLC will be the registered owner of your vehicle, and not you personally. The important thing is for you to know the Use Tax laws yourself. Then you will have solid information to guide your decisions. If you need to, check in with an attorney to set your mind at rest.

  • How do I register a financed vehicle?
If you are planning to finance a vehicle purchase, it's advisable that you speak with your lender ahead of time and make sure they are aware and amenable to the fact that this vehicle will be owned by your Montana LLC, not you personally. Your name cannot/will not appear on the title. If you want to register a vehicle that you have already registered in your personal name, there is an additional requirement of the lien-holder, in the form of a consent note, essentially agreeing that your Montana LLC will be the sole owner of the vehicle; your personal name will not appear on the title at all. Per Montana DMV requirements, the consent note from the lien holder, on the the lien holder’s letterhead, needs to state “We authorize (name of Montana LLC) to register this vehicle in Montana.” The note would also need to state the year, make, and VIN of the vehicle being financed. Please note that only the name of the Montana LLC can be put on the title and registration—your personal name cannot be on there, as you are not a Montana resident. That note would then need to be mailed to us with the ORIGINAL vehicle title/MCO document (which needs to be made over into the name of the LLC).Lastly, we recommend confirming with your lender what information they will need about your Montana LLC. We can provide a copy of the filing of your Montana LLC, and can get you an EIN (commonly referred to as a tax ID number) from the IRS. We can send you the form needed to get the EIN, and apply for it after you return it to us
